These Terms of Service (“Terms”) govern your use of poweredbycatalyst.com, any pages we publish under it, and the communications described below, including our text messaging (SMS/MMS) and voice calling program. By using the site, submitting an inquiry, or opting in to receive messages or calls from us, you agree to these Terms and to our Privacy Policy.
If you do not agree with these Terms, please do not use the site or opt in to our messaging program.
You may use the site for its intended purpose: learning about our services, reading what we publish, and contacting us. You agree not to misuse the site, which includes attempting to breach its security, scraping it in a way that burdens it, submitting false or misleading information through our forms, or using it for anything unlawful.
The descriptions of services on this site are informational, not an offer with fixed terms. Actual engagements (web design, CatalystOS builds, directory and Google Business Profile work, hosting, and support) are governed by the separate written agreement we sign with each client. If anything on this site conflicts with a signed client agreement, the signed agreement wins.
Powered by Catalyst uses text messaging (SMS), multimedia messaging (MMS), and voice calls so we can communicate with clients and people who have asked to hear from us. These terms describe how the program works.
If you opt in, you may receive SMS text messages, MMS messages (texts that include images, documents, or other media), and voice calls from Powered by Catalyst related to your inquiry or engagement, such as: replies to questions you send us, project and service updates, scheduling and appointment reminders, billing notices, and occasional messages about our services. We send conversational, customer-care style communications, not bulk promotional blasts.
You will only receive text messages and calls from us if you have opted in: for example, by providing your phone number and agreeing to be contacted through a form, in a written or signed agreement, or by texting or calling us first. Consent to receive text messages or calls is not a condition of purchasing any goods or services from us. Your phone number, mobile opt-in, and consent will never be shared with or sold to third parties or affiliates for their marketing or promotional purposes.
Message and call frequency varies depending on your engagement and the conversation. Message and data rates may apply to SMS and MMS messages. Charges are billed by your mobile carrier under your plan. You must be the account holder for the phone number you provide (or have the account holder's permission) and be 18 years of age or older.
You can cancel at any time. Reply STOP to any text message from us to unsubscribe. After you send STOP, we will send one final message confirming that you have been unsubscribed, and you will receive no further SMS or MMS messages from us. To stop receiving voice calls, tell us on a call or email alex@poweredbycatalyst.com and we will remove your number. If you want to rejoin, you can opt in again the same way you did the first time.
If you are experiencing issues with the messaging program, reply HELP to any text message from us for assistance, or email alex@poweredbycatalyst.com and we will get you sorted out directly.
Carriers are not liable for delayed or undelivered messages. Message and call delivery depends on your carrier and device, and we cannot guarantee that every message or call will be delivered or delivered on time.
If you have any questions about how we handle your data, including your phone number, read our Privacy Policy. In short: we use your number to send you the messages and calls you opted in to, and we do not share phone numbers, text messaging originator opt-in data, or consent with third parties or affiliates for marketing purposes.
We may suspend or end the messaging and calling program, or change these terms, at any time. Material changes will be posted on this page.
The content on this site (text, design, graphics, logos, and code we wrote) belongs to Powered by Catalyst unless otherwise noted. You may read, link to, and share it; you may not republish it wholesale or pass it off as your own. Client names and logos shown on the site belong to their respective owners and appear with permission.
The site may link to third-party sites and uses third-party tools (described in our Privacy Policy). We do not control third parties and are not responsible for their content, practices, or availability.
The site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We may update these Terms from time to time. If we do, we will post the updated version on this page. For material changes, we will take reasonable steps to make the change more visible. Your continued use of the site or the messaging program after changes are posted constitutes acceptance of the updated Terms.
